Your order for purchase constitutes your “offer” which shall be subject to these Terms and Conditions. Kernova Foods, a brand owned and operated by Alphabell Agrofoods Pvt. Ltd. (“Kernova”), reserves the right to accept or reject your offer without assigning any reason.

By accessing or using kernovafoods.com, you agree to be bound by these Terms and Conditions. Kernova reserves the right to add, alter, modify, or update these terms at any time without prior notice. You are advised to read these terms carefully each time you visit the website.

2. Eligibility

The user certifies that they are at least 18 years of age or have obtained the consent of a parent or legal guardian to use this website and place orders.

3. Product Accuracy

Kernova Foods has made every effort to display the colour, size, packaging, and appearance of products as accurately as possible. However, the actual colours displayed may vary depending on your device or monitor settings, and we cannot guarantee complete accuracy of such displays. Product weights and measurements mentioned on the website are approximate and may vary slightly due to natural packaging and manufacturing conditions.

4. Pricing & Availability

The prices and availability of products are subject to change without prior notice at the sole discretion of Alphabell Agrofoods Pvt. Ltd. Kernova reserves the right to refuse or cancel any order placed for a product listed at an incorrect price, due to technical errors, stock unavailability, or for any other reason. This right applies regardless of whether the order has been confirmed and/or payment has been received. In such cases, the payment shall be refunded in full and the customer shall be informed accordingly.

5. Disclaimer of Warranties

All products sold through Kernova Foods are subject only to any applicable warranties provided by their respective manufacturers, distributors, or suppliers.

To the fullest extent permitted under applicable law, Alphabell Agrofoods Pvt. Ltd. and Kernova Foods disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Neither Alphabell Agrofoods Pvt. Ltd. nor Kernova Foods shall be liable for any consequential, incidental, indirect, punitive, or special damages, including but not limited to loss of profits, loss of business, loss of goodwill, or loss of data arising from the use of the website or products purchased through the website.

6. Shipping Responsibility

Kernova Foods takes responsibility for processing and dispatching your order. Once the order has been handed over to our logistics partner (including Shiprocket or any designated courier partner) and a tracking ID has been generated, delivery timelines become subject to the logistics provider’s operations.

If non-delivery, delayed delivery, return-to-origin (RTO), or additional shipping costs arise due to incorrect or incomplete information provided by the customer, recipient unavailability, refusal to accept delivery, or any customer-related issue, any additional expenses incurred may be recovered from the customer.

7. User Accuracy

The user agrees to provide accurate, complete, authentic, and up-to-date information while registering, placing orders, or interacting with the website.

Kernova reserves the right to verify user information at any time. If any information is found to be false, misleading, incomplete, or fraudulent, Alphabell Agrofoods Pvt. Ltd. reserves the right to reject orders, suspend user accounts, terminate registrations, and restrict access to services without prior notice.

8. Payment & Fraud

Kernova Foods shall not be liable for any credit card, debit card, UPI, net banking, wallet, or other payment fraud. The responsibility for fraudulent usage of any payment method lies solely with the user.

Users must use only payment instruments that they are legally authorized to use. All online payments are processed through secure payment gateways, including Cashfree Payments and its authorized partners.

9. Complaints & Disputes

Any complaint regarding product quality, packaging, shortages, damages, or delivery issues must be reported within seven (7) days from the date of delivery. Complaints raised after this period may not be entertained.

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms, the website, or products sold by Kernova Foods shall be subject to the exclusive jurisdiction of the competent courts having jurisdiction over the registered office location of Alphabell Agrofoods Pvt. Ltd.
